1. Scope
For all deliveries of internet commerce "Die Circuskiste" to consumers we use according to (§ 13 BGB) these terms and conditions (GTC).

3. Offer and Conclusion
3.1 The presentation of products in our online shop is not a legally binding offer, but an invitation to order. All offers are "while supplies last", unless specified in the product details otherwise. Errors are possible.

3.2 Clicking the bottom 'Buy' in the final step of the ordering process is a binding order for the goods in your shopping cart. The sales contract is concluded, when we accept your order with confirmation by e-mail immediately after receiving your order.

4. Right of revocation
4.1 Consumers (§ 13 BGB) have a right of revocation.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good. The right to withdraw does not apply to contracts for the supply of goods made to customer specifications.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, where applicable, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. In Case of bulky items you will have to bear the direct cost of returning the goods. The cost is estimated to border BRD at a maximum of approximately 65,00 EUR, outside border you will additional have to pay same amount charged with delievery.
You are only liable for any diminished value of the products resulting from handling the products, which goes beyond what is necessary to determine the nature, characteristics and functioning of the products.

5. Prices and delivery costs
5.1 The mentioned prices on the product pages include the VAT and other price components. Standard packages are delivered in germany free from a value of 150, - EUR, all other countries will be delivered by the applicable exemption levels, which can be found on the page 'Shipping & Returns'.

5.2 In addition to the prices we charge shipping cost for delivery. Shipping fees are available on the product pages, in the shopping cart system, and on the confirmation page at any time via the link displayed. Shipping fees and allowances of delivery are automatically calculated in the cart after selecting your country .

5.3 When paying by COD DHL extra costs in the amount of EUR 6.90 are nessesary inclusive a fee with the amount of EUR 2.00 for DHL, collected by delivery. COD deliveries can only be done in germany.

5.4 For delivery to EU countries there is no customs and tax, for delivery to non-EU countries delivery is done without paying duty or tax. For the relevant customs and tax amounts please inquire with your local customs-office.The calculation of the fee will be done by country-choise automatically in your shopping cart.

6. Delivery
6.1 Delivery is done within germany with our service partner DPD and DHL, bulk supplies of appropriately labeled products by freight carriers. Delivery abroad is done by DPD, UPS, DHL and bulky items by freight carriers.

6.2 Delivery times for all our products are recognized in the shop and valid for shipments within Germany. The delivery times for all other EU countries increase by 4 Workdays.

6.3 The deadline for delivery begins to run when paying in advance on the day after the payment order to the remitting bank or with other payment methods after the conclusion on the same day, and ends with the expiry of the last day of the period. If this is a Saturday, Sunday or a public holiday nationally recognized, the last day of the period is the next business day at the place of such a day.

6.4 If you order from us multiple items With different delivery times, we ship the goods in a common mission, unless we have agreed otherwise with you. In this case, for the whole consignment the delivery period applies to the items in your order with the longest lead time.


7. Payment
7.1 Payment will be done as a first customer either in advance (3% discount), credit card or with PayPal. As a registered customer of Die Circuskiste you will receive your goods easily by invoice, credit card, PayPal or direct debit (3% discount).

7.2 With the advance payment, we will provide in our order confirmation our bank details and deliver the goods after payment is received.

7.3 When selecting the PayPal payment method, you must be registered with Pay Pal in order to be able to pay the invoice amount, or you must first register and authenticate yourself with your access data. The payment transaction is carried out automatically by PayPal immediately after confirmation of the payment order. You will get more information during the ordering process.

7.4 When selecting the payment method credit card, our service partner PayPal takes over the control and confirmation of your payment - if this is confirmed positively, we deliver your order immediately. You do not have to be registered with PayPal. You will get more information during the ordering process.

7.5 When you choose pay direct debit collection we pull the invoice due 8 days after the shipping of goods from the account you specified.

7.6 A right of set off is available only if your counterclaims have been legally established court or acknowledged in writing by us.

7.7 You can only withhold payment if the claims result from the same contractual relationship.

8. Retention of title
Until full payment the goods remain our property.


9. Warranty
For all the goods in our shop you have  legal warranty rights.


10. Our regular customers and discount system
With your first order at Die Circuskiste you will be, if you have not ordered as a guest, with the application of a customer's account a regular customers of Die Circuskiste. After your first payment is done we will, depending to your fist turnover, install a regular customer account for you with 3%  or 10% discount. This allows you on the one hand in future a uncomplicated purchase on account, on the other hand, we offer all our customers this tiered discount, and this will be automatically calculated already in the display of articles, and displayed for each individual item. So you always see directly what you ultimately will pay for the respective item.

Die Circuskiste offers the following discounts:
All charitable and social institutions receive from us, if adequate justification is possible, a discount of 10% on almost all products. Excluded are products marked as bulky articles, as well as offers, videos and books (Sorry - price maintenance).

For bulk orders of EUR 400.00 we also grant this discount. As a regular customer you will receive a basic discount of 3%, if your repeat business orders reaches a values above EUR 400.00, you automatically get a basic discount of 10% for all further orders. By using the direct debit method of payment, you achieve a discount rate of up to 13% with us.

Ordering
Ordering is done in four simple steps.
If you have found a product, you can use 'Add to Shopping Cart' to send the item without obligation by clicking the button into the shopping cart. The content of the basket can be viewed at any time by clicking the button 'Shopping cart' . The products can be determined by changing the number and 'Update' as well as you can remove individual items from the cart. If you want to buy the products in your cart, click the button 'Checkout'. First, select the desired mode of delivery - we deliver to zones which are automatically calculated by selecting your country in the postage depending on the order value. In addition, you can chose the free pickup in our warehouse. Chose now the desired payment method, then enter the data you are requested. All mandatory fields are marked with *. The entire ordering process is encrypted, data for credit card and instant transfer are not available to us, and will be verified by the service provider PayPal. After entering and confirming your payment data, please check your entries finally, and then please confirm also the acceptance to our business and delivery. By clicking the bottom 'Buy' you finaly complete the ordering process. The process can be closed at any time by closing the browser window. On all other ordering-pages you can always go back to the individual order steps, and make your changes.
